Software Licence

These terms cover the software that comes with PEBL kit: the PEBL App, any PEBL web portal or online service, and the firmware running inside the kit itself. Using any of it means you accept these terms.

Who we are

What you can do

We give you a licence to use the software for your own monitoring, research or operational purposes, and to use the firmware in kit you own or lawfully operate. The licence is non exclusive, cannot be transferred to someone else, and lasts for as long as you keep to these terms.

You do not need a separate licence for each person in your team. If you own or hire the kit, your organisation can use the software with it.

What you cannot do

Please do not:

  • sell, rent, sublicence or redistribute the software;
  • reverse engineer, decompile or disassemble it, except where the law says you may despite this restriction;
  • remove or hide any copyright or ownership notice;
  • use it to break the law or to infringe anyone else's rights;
  • try to reach systems or data that are not yours.

Who owns what

The software is licensed to you, not sold. PEBL and its licensors keep all intellectual property rights in it.

Your data is yours. Footage, sensor readings and everything else your kit records belong to you. We only need enough permission to store and process it where that is what makes the software work for you, and to help you when you ask for support.

The PEBL App runs on the device over a local WiFi network with no internet connection, so your captured footage and sensor data stay on the device and its SD card unless you move them yourself. Our Privacy Policy explains how we handle personal data, and it forms part of these terms.

If we use aggregated or anonymised data to improve our products, we will make sure it cannot reasonably be traced back to you or your sites.

Open source components

The software includes third party and open source components, licensed to you under their own terms. Where those terms conflict with this licence, theirs apply to those components. Ask us and we will tell you which components and licences are involved.

Updates

We update the software from time to time to fix problems, improve it, or keep it secure. Some updates install on their own. We cannot promise the software will always be available or completely free of defects.

What we do not promise

We provide the software as it is. Beyond what the law requires of us, we do not give any implied guarantee that it is of satisfactory quality or fit for a particular purpose.

On the data itself. PEBL kit produces data for monitoring and research. Deciding whether that data is good enough for a regulatory, statutory or safety purpose is your call, and validating it for that purpose is your responsibility. If you need certified or compliance grade measurement, check the specification for your kit and talk to us first.

Liability

Nothing here limits our liability for death or personal injury caused by our negligence, for fraud, or for anything else the law does not let us limit.

Otherwise, we are not liable for lost profit, lost business, lost or corrupted data, or indirect or knock on losses. Our total liability connected with this licence is limited to what you paid us for the kit or software that the claim relates to, in the twelve months before the claim arose.

If you are a consumer, none of this affects your statutory rights.

Ending the licence

This licence runs from the first time you use the software until it ends.

You can end it at any time by stopping using the software and removing it. We can end it if you seriously break these terms and do not put it right within 30 days of us asking.

When it ends, your right to use the software ends with it. The sections on ownership, your data, what we do not promise, liability and the general terms below carry on applying.

General

This licence is governed by the law of England and Wales, and the courts of England and Wales have exclusive jurisdiction.

If any part of it turns out to be invalid or unenforceable, the rest still applies.

We may update these terms. Any change goes on this page, and carrying on using the software after a change takes effect means you accept it.
